‘Above award’ pay does not immunise employers from Modern Award obligations
Employers still largely unaware how new modern awards will apply to their employees
29 June 2010 – Many employers risk liability for back-pay and penalties following the implementation of the Modern Awards under the new Fair Work Act because they have mistakenly assumed that if they pay above award rates or salaries other award obligations, such as leave loading, overtime, and penalty rates will not apply to their business, according to Harmers Workplace Lawyers.

STATEMENT FROM HARMERS WORKPLACE LAWYERS RE: DAVID JONES EMPLOYEE MATTER

21 June 2010 - Harmers Workplace Lawyers wishes to confirm that Kristy Fraser-Kirk is the David Jones employee for whom it is acting in the matter relating to Mark McInnes, the company’s former CEO.

To date, the firm has not revealed her identity so as to try and protect her privacy. However, another party thought it in their interest to leak Ms Fraser-Kirk’s name to the media. Yesterday's media revelation means that withholding her identity is no longer possible.

Ms Fraser-Kirk has had to leave her own home due to the pressures of the media who have been staked out there. Also, unfortunately, other female David Jones employees are being approached by the media speculating that they are the woman involved. By confirming Ms Fraser-Kirk’s identity, Harmers Workplace Lawyers requests that media respect the privacy of both Ms Fraser-Kirk and those other employees.

Whilst it is legitimate for the media to report this serious and important matter, we would request that they refrain from pursuing Ms Fraser-Kirk. Neither Ms Fraser-Kirk nor Harmers Workplace Lawyers will be making any further comment at this time.
