Environmental, social, and corporate governance (ESG) and its impact on businesses in Latin America

Environmental, Social, and Governance (‘ESG’) criteria are increasingly important in measures of corporate performance from the perspective of investors, employees, and business partners, and the influence of ESG is expanding rapidly in Latin America. Within both the ‘social’ and ‘governance’ categories, workplace matters are critical: diversity, equity, and inclusion (‘DEI’) among the workforce, Board composition, labour relations, work-life balance including alternative work arrangements, pension investment, observance of international labour standards in outsourcing, and management of employment law claims all can factor into an employer’s ESG rating. In this webinar, our panel will consider the unique legal issues arising in Latin America from the increasing focus on ESG.

The EU Pay Transparency Directive: A far-reaching instrument imposing more than just transparency

At one time largely a U.S. concern, pay equity and transparency have rapidly become globally important to all multinationals wherever headquartered. The EU Directive on pay transparency is a milestone, having been adopted with a clear objective: closing the gender pay gap and making it easier to bring equal pay claims. Although Member States have three years to implement the Directive, businesses should react proactively and take appropriate action to ensure compliance and avoid the cumbersome requirement of conducting ‘pay assessments’. By introducing powerful enforcement mechanisms to strengthen the new reporting requirements, the Directive will have a major impact on businesses. During the webinar, our employment experts on both sides of the Atlantic will place the Directive requirements in a global context, and share their knowledge and insights concerning global best practices.

Latest developments in Data Protection in Asia-Pacific

2023 has been a very significant year regarding Data Protection in the Asia-Pacific region. Jurisdictions are amending their laws to align them more closely with European privacy rules. But at the same time the specific rules in Asia-Pacific vary widely. For example in India where the long-awaited Digital Personal Data Protection Act, 2023 has come into effect, which will have a significant impact. Or in Australia where long overdue proposed reforms are being discussed, with a proposed implementation date of 2024. In addition, Artificial intelligence (AI) has come to dominate the headlines and a lot of conversations; equally there are many concerns about when and how data protection laws are able to govern situations where the design and deployment of machine-learning AI models or systems involve the use of personal data.

Employers need to take into account the aforementioned issues when dealing with multi-jurisdictional matters and preparing data protection policies in Asia-Pacific. This webinar will address the current laws and the proposed reforms in data protection and how employers can be better prepared under the new laws.

The Employers of Record (EOR) ‘rules’ in Latin America: Argentina, Chile, Colombia, Mexico and Peru

One of the most common areas of concern to cross-border clients today is the use of the Employer of Record solution as an alternative or adjunct to setting up local operations.  While the advantages of an EOR (having a single provider for payroll services and HR compliance in a country where the company has no presence) are clear, many employers struggle to reconcile the wide promotion of EOR solutions with the complicated legal contexts in particular countries. In this webinar, we will focus on Latin America and answer the basic questions clients have: is an EOR solution permitted? Does it have legal limitations? Are there specific provisions needed in the agreement with the EOR? Does the client become a ‘co-employer’ with the EOR and, if so, what are the ramifications? And, if the EOR solution is unavailable or risky, what alternatives does the foreign employer have? In this webinar, our attorneys will discuss these questions for several Latin American countries and offer tips that can be implemented in your business.
